Eligibility Criteria

1

Bidders shall not be under a declaration of ineligibility for corrupt and fraudulent practices issued by Government of Karnataka

2

It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of e-Procurement on or before the last date and time of bid submission.

EMD Payments through e-Payment mode shall be made as one single transaction and payments made in part are liable for rejection.

The rates shall be excluding GST. GST will be paid to the tendered amount separately as per prevailing rates. The amount put to tender is excluding GST.

The bidder should only submit / upload in KPP portal platform genuine certificates / documents , etc., that are as obtained from competent / concerned authorities against each required eligible criteria. Any of the submitted / uploaded certificates / documents etc., found to be fake after verification from issuing authority, then his / her EMD will be forfeited, besides proposed for making such bidders for blacklisting.

Tender will be opened in the office of the Executive Engineer Karnataka Neeravari Nigam KNNL GRBCC Division No.4 Chikodi, Belagavi District in presence of the bidders who wish to participate

The Bidder / Firm / Company is required to ensure browser compatibility of the computer well in advance to the last date and time for receipt of tenders. The departments shall not be responsible for non-accessibility of KPP portal due to Internet connectivity issues and technical glitches.

If any of the dates mentioned above happens to be a General Holiday, the next working day will holds good.

Conditional tenders are liable to be rejected. The officer competent to accept the tenders shall have the right to reject any or all the tenders without assigning any reason whatsoever

As per the Government order No. LT/300/LET/2006 Bangalore Dt:-18-01-2007 a sum amounting to 1% of the bill amount of the contractor will be deducted towards cess and will be credited to the Karnataka building and other Constructions labour welfare fund.

Any bidder who is otherwise technically qualified withdraws from the bidding process at any stage before a final decision is taken on the tender, the EMD of such bidder shall be forfeited, the name of such bidder shall be removed from the category list of contractors at least for a minimum period of one year in DEPARTMENT/KPWD, besides making such bidders liable for blacklisting

The payment of bills for these works will be made as and when letter of credit received under the same Head of Account from Govt. of Karnataka

Typo-graphical errors if any will not be the ground for any claims by the contractor

If many bidders quoted lowest same price to the work and the award of work will be done by toss/ lottery system or by obtaining no objection certificate in this regard by other contractors who have quoted the same price

The work shall be tackled and completed within prescribed tender period

No interest will be paid by Karnataka Neeravari Nigam Limited on the Earnest Money deposited

The contractor is responsible for any damages due to natural calamity the government or Nigam will not give any compensation for until the completion of maintenance period

The currency period of the tender shall be 180 days from the date of opening the tender/tenders. If delay in deciding the tender is inevitable, the consent of the tenderer agreeing to keep open his offer for a minimum further period should be obtained in advance. The minimum further period for which the tenderer is required to keep his offer open should invariably be specified before his consent is obtained

During technical evaluation, if the employer finds that any certificates / information furnished is false, such bidders will be disqualified and barred from participation in the bid

If any bidder fails to satisfy the conditions mentioned above, such bids will be rejected and their financial bids will not be opened

The Bidder shall be responsible for successful performance of the contract

The Bidder to participate in the tender under single bid basis only. Any violation will attract disqualification of the bid

If the percentage quoted by the contractor for the work is below ninety percent of the updated recast estimated amount put to tender, then the contractor shall furnish an additional performance security in the form of Bank Guarantee for an amount equivalent to the difference between the cost as per quoted percentage and 90% of the updated cost put to tender. In case of contractor quoting above 125% of updated cost put to tender, then the over and above 125% of the updated cost put to tender will be withheld during the progress of work. The additional performance will be released proportionately to the bill amount till the contractor achieves progress of the entire cost of the work as per agreement. The withheld amount in the later case will be released only after entire work contracted is fully completed and so certified by the Executive Engineer. (If BG submitted while issuing fresh BG or extending any existing BG, claim period of a minimum one year from the date of expiry of validity period of BG is to be specified invariably)

The tender processing charges paid by the bidder/firm/company are not refundable even if the tender is cancelled

The bidder/firm/company shall send the authorization letter for their representation duly attending their signature

The Employer shall give notice to the Contractor of any Defects before the end of the Defects Liability Period, which begins at Completion and is defined in the Contract Data. The Defects Liability Period shall be extended for as long as Defects remain to be corrected

Maintenance period or the Defect liability period for this work is 12 months from the date of completion of work

The Bidder to participate in the tender under single bid basis only. Any violation will attract disqualification of the bid.

In case death of a contractor after execution of the agreement/ commencement of the work , his legal heir if any eligible registered contractor & willing can execute to complete the work at the accepted tender rates irrespective of the cost of the work.

The necessary certificates / documents in support of eligibility criteria to be fulfilled as stipulated shall be scanned and attached to e- tender document. The scanned copy (preferably in PDF form) of the required pre-qualification documents should be uploaded to the tender and the self-attested copies of the document of all details uploaded to the e-portal & original documents should be produced, for verification when asked by the department. If failed, the tender will be treated as non-responsive bid and will be rejected.

Scanned signature of the Bidder/ Firm/ Company authorized representative shall be attached while uploading the bid document.

Incomplete tender documents will be rejected.

The Bidder/ Firm/ Company should adhere to the accepted execution plan submitted by him under any circumstances without linking to the pending payment of the work & also Land acquisition Problems if any.

Time allowed for completion of the work from the date of Agreement to the contractor is 2 (Two) months including monsoon period.
