The tenderer is subjected to be black listed and the EMD forfeited if he is found to have misled or furnished false information in the forms/statements/certificates submitted in proof of qualification requirements or record of performance such as abandoning of work not properly completed in earlier contracts, inordinate delays in completion of the works, litigation history and / or financial failures and /or participated in the previous tendering for the same work and had quoted unreasonable high bid prices. Even while execution of the work, if found that the contractor had produced false/fake certificates of experience he will be black listed and the contract will be terminated. All disputes or difference arising of or relating to the Contract shall be referred to the adjudication as follows: a) Claims upto a value of Rupees 10,000/-. - Regional Officer, (PR) Region, Wanaparthy b) Claims above Rs.10,000/- and up to Rupees 50,000/-. - Engineer-in-Chief (PR) Administration, Hyderabad The arbitration shall be conducted in accordance with the provisions of Indian Arbitration and Conciliation Act 1996 or any statutory modification thereof. The arbitrator shall state his reasons in passing the award. Claims above Rs. 50,000/-. All claims of above Rs.50,000/- are to be settled by a Civil Court of competent jurisdiction by way of Civil suit and not by arbitration. The Contract shall make a reference for adjudication under this clauses shall be made by the contractor within six months from the date of intimating the contractor of the preparation of final bill or his having accepted payment whichever is earlier
