Tenderer to confirm that they will furnish Bank Guarantee towards security deposit before execution of the contract Agreement

Sales tax on Works contract, Turnover Tax on any other similar taxes under the Sales Tax, Act, as applicable, are included in the Bid/tendered price and BSPTCL/Purchaser shall not bear any expenditure/liability on this account. Entry tax, if any shall be extra.

It is hereby confirmed that if any income-tax, surcharge on income tax or any other corporate tax is applicable/payble under the law, the same shall be paid by the contractor.

Confirm that additional conditions, deviations, if any, found in the proposal documents other than those stated in the deviation schedules, save the pretaining to any rebate, offered, shall stand with drawn.

Confirm that minimum quoted Service Charge shall be more than 5% (upto atleast 2 decimal)

The Bidder shall ensure the compliance of Private Security Agencies (Regulation) Act, 2005, Govt. of Bihar.

The rates of wages of different category of Security personnel shall not be less than the rates of minimum wages prescribed by the Labour department, Government of Bihar Gazette from time to time.

No other dues on any account shall be payable by the BSPTCL except the rates of the Bidders for wages agreed upon and subsequent revision thereof during the period of agreement.

Mobilization period for Security Personnel and Supervisor will be 30 days from the date of N.O.A.

If it is found that any amount is payable by the successful Bidder towards wages, allowance and statutory dues in respect of the Security Personnel or any loss of BSPTCL property, the same shall be adjusted from the Security Deposit to the extent of the amount so determined reserving the right to recover the deficit amount through other modes of recovery, including the right to terminate the agreement by giving 02 (Two) months notice.

The successful Bidder shall be solely and exclusively responsible for engaging their Security personnel. The BSPTCL will have no liability whatsoever concerning the employees of the Bidder.

The Bidders shall have to make regular and full payment of all wages and allowances to its workers / employees so also the statutory dues, etc. He shall also be liable to indemnify BSPTCL against all losses, damages caused to any commission and omission on the part of the Security personnel deployed by him.

The Bidder / Agency shall not be allowed to transfer, assign, pledge or subcontract/sublet its rights and liabilities under this Agreement to any other Agency or Organization by whatever name be called.

The Security personnel deployed shall be required to report for work as per the direction issued by the in-charge and are required to work for eight hours in a day. In case, the person deployed remains absent on a particular day or comes late / leaves early on three occasions, proportionate deduction from the remuneration for one day will be made.

The agency/firm shall provide round the clock Security to all areas covered in this tender by deploying full-proof Security measures.

Supervisor shall be responsible for immediate interaction with the Incharge where the personnel are to be deployed so that optimal services of the persons deployed could be availed without any disruption. The concerned Incharge shall monitor the deployment of Security Guards as stipulated at Clause no-10.

The entire financial liability in respect of Security personnel deployed in BSPTCL will in no way be liable. It will be the responsibility of the Bidder / Agency to pay to the person deployed a sum not less than the minimum wages prescribed by Labour department, Govt. of Bihar and adduce such evidence as may be required by the Authority of BSPTCL.

The Bidder / Agency shall be solely responsible for the redressal of grievances or resolution of disputes relating to Security personnel. If matter does not resolved by the Agency, matter may be put up before GM-cum-CE of concerned Zone.

The Authority of BSPTCL shall not be responsible for any financial loss or any injury to any Security personnel deployed by the Bidder / Agency in the course of their performing the functions/duties, or for payment towards any compensation.

The Security personnel deployed by the Bidder / Agency shall not claim nor shall be entitled to pay, perks and other facilities admissible to regular / confirmed employees during or after expiry of the Agreement.

In case of termination of this Agreement on its expiry or otherwise, the Security personnel deployed by the Bidder / Agency shall not be entitled to and shall have no claim for any absorption in regular or other capacity.

The Bidder / Agency shall provide a substitute well in advance if there occurs any probability of the Security personnel leaving the job due to his own personal reasons. The payment in respect of the overlapping period of the substitute shall be the responsibility of the Bidder / Agency. The Bidder / Agency shall be responsible for contributions towards Provident Fund and Employees State Insurance, wherever applicable.

The Security personnel deployed by the Bidder /Agency should have good police records and no criminal case should be pending against them.

The Security personnel deployed should be polite, cordial and efficient while handling the assigned work and their actions should promote good will and enhance the image of the BSPTCL. The Bidder /Agency shall be responsible for any act of indiscipline on the part of the Security personnel deployed. In that case, agency must replace the errant security personnel by another one.

The Bidder /Agency shall also supply Dress / Uniforms suitable to summer and winter season and other equipments/ accessories like baton (lathi), torch, Raincoat, Gumboot, Umbrella, Whistle including I-card etc. to each Security personnel at its own cost and expenses. Rechargeable search light to be provided to each unit/place like Zone/Circle/GSS/Store/IB/CRITL.

Agency shall ensure Smartphone to Supervisors for the use during working hours. Monthly recharge of phone will be done by agency. No reimbursement will be done against this by BSPTCL

The Security Guard to be deployed by Agency for the purpose of rendering will be appointed by the agency at his sole and own risk after being satisfied of their being physically fit and verification of credentials. However, final authority to accept or reject the proposed Security Guard deployment rest with concerned GM-cum-CE of Transmission Zone.

If Security Guard is not found in uniform/dress during duty hour, a fixed amount of Rs. 500 per month shall be deducted from the bill of agency.

The bidder shall have no claim whatsoever against the BSPTCL for any loss / damage caused to the Bidder / Agency by reasons of war, riot, commotion disturbance, pestilence, epidemical sickness, strike, lockout, earthquake, fire, storm, flood, explosion or any change in the nature, breakdown of plant or machinery for whatever reasons.

Deployment of Security Personnel at one location shall be maximum of 1 (one) year. Accordingly, transfer of Security Guards shall be made from one location to other location. Financial expenses incurred in this regard shall borne by Security Agency.

Security agency is to provide valid license for armed security guard and security agency shall be held responsible for any misuse of the arms.

The daily wages of Unarmed and Armed Security Guards are at par with the daily rate of Semiskilled and Skilled Category of Labourers respectively as communicated by the Govt. of Bihar. At present the daily wages per person being paid by the BSPTCL in line with the Govt. order is as follows : (a) Unarmed Security Guard (Semiskilled category) = Rs. 330/- per day (b) Armed Security Guard (Skilled category) = Rs. 403/- per day (c) Supervisor/Clerical = Rs. 9111/- per month
