The purchaser reserves the right to vary quantity by up to 25% and to extend delivery per contract terms. Arbitration is via a sole arbitrator mutually agreed.

Technical Specifications & Requirements

• Items: SMC power cylinders, Nepack make power positioners and accessories; all items are proprietary to SMC Corporation India Pvt Limited.
• Authorized supplier: NEPACK ASSOCIATES only; no alternate makes acceptable.
• Scope: Only supply of goods (no services).
• Pricing: Prices firm and fixed till execution; inclusive of all taxes, freight, P&F, transit insurance.
• Payment: 100% payment within 10 days of CRAC on online submission of bills.
• Delivery/Extension: Option clause allows up to 25% quantity variation with delivery period adjusted per formula; minimum extension is 30 days unless original period >30 days.
• Dispute: Arbitration by a sole arbitrator mutually appointed.
• Documentation: Bidders must submit declarations/undertakings as per additional scope.

Terms, Conditions & Eligibility

• The procurement is restricted to the NEPACK ASSOCIATES as the authorized proposer for SMC & Nepack goods; other bids may be rejected as unsolicited.
• Bidder must accept GeM GTC payment terms (100% within 10 days of CRAC).
• The scope of supply is limited to the listed proprietary items; no alternate brands will be entertained.
• Arbitration clause specifies mutual appointment of a sole arbitrator; compliant with contract norms.
• Finance approvals and authority confirmations dated in 2025 indicate internal concurrence for the proposal.
• All declarations/undertakings in the additional scope must be duly filled, signed and stamped.
