Tenderers should not be associated, or have been associated in the past, directly or indirectly, with a firm or any of its affiliates which have been engaged by the Purchaser to provide consulting services for the preparation of the design, specifications, and other documents to be used for the procurement of the goods to be purchased under this Invitation of Tenders.
Bidders shall not be under a declaration of ineligibility for corrupt and fraudulent practices issued by Government of Karnataka
It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of e-Procurement on or before the last date and time of bid submission.
EMD Payments through e-Payment mode shall be made as one single transaction and payments made in part are liable for rejection.
Successful bidder should supply chemicals in advance
Amount will be paid as and when grants will be released
For selecting/finalizing successful bidder, whoever will quote lowest in totals of all chemicals in package (lowest amount when we add rates of all chemicals) would be the successful bidder
Above condition is because to test one single soil sample , lab need all the 27 chemicals, so if one bidder will supply all chemicals at a time, it would be easier to test soil samples in time and can provide soil test results to farmers in time
Scope of Supply The supplier shall supply laboratory chemicals reagents and related materials required for analysis of soil samples in the Soil Health Laboratory of the Department of Agriculture
Quality and Grade All chemicals shall be of the grade and purity specified in the Schedule of Requirements such as AR/Analytical Reagent
Original and Genuine Material All chemicals shall be Genuine and manufactured by the original manufacturer Supplied in original unopened and properly sealed containers Free from contamination deterioration and physical damage
Batch/Lot number Purity/assay Specification Date of manufacture Expiry/retest date
Safety Data Sheet Safety Data Sheet (SDS/MSDS) shall be supplied for hazardous chemicals wherever applicable The supplier shall ensure that hazardous chemicals are packed labelled and transported in accordance with applicable statutory safety requirements
Shelf Life At the time of delivery the chemicals should normally have at least 75% of the manufacturers stated shelf life remaining, unless otherwise specified in the Schedule of Requirements For chemicals having a short stability period, the laboratory may prescribe a higher minimum remaining shelf life
Delivery The chemicals shall be delivered to the Soil Health Laboratory at the address specified in the Purchase Order within the stipulated delivery period The quoted price shall include all applicable costs of packing, forwarding ransportation insurance loading/unloading and delivery unless specifically stated otherwise in the tender
Packing Chemicals shall be packed suitably to prevent leakage breakage contamination deterioration or damage during transportation and storage Hazardous corrosive inflammable or otherwise sensitive chemicals shall be suitably packed and labelled
Inspection and Acceptance The supplied chemicals shall be subject to inspection by the authorised officer inspection committee of the Soil Health Laboratory The laboratory shall verify Quantity Chemical name and grade Pack size Batch number Expiry retest date Physical condition of the container Compliance with the prescribed specification
Testing of Chemicals Where considered necessary, the Department/Laboratory reserves the right to test the supplied chemical or reagent in its own laboratory or through another Government/recognised laboratory If the material fails to conform to the prescribed specification, the supplier shall replace the material at his/her own cost
Rejection The Department reserves the right to reject chemicals which are Expired or near expiry beyond the permitted limit Damaged or leaking Tampered with Incorrectly labelled Contaminated Not of the specified grade/purity Short supplied or Otherwise not conforming to the tender/Purchase Order
Replacement of Rejected Material Rejected materials shall be collected and replaced by the supplier at no additional cost to the Government within the period specified by the competent authority No payment shall be made for rejected material
Price The quoted rates shall clearly indicate the basic price, applicable GST and other statutory charges, as applicable. No additional charges shall be payable unless specifically accepted by the competent authority
Delivery Period The supplier shall complete delivery within the period specified in the Purchase Order Any request for extension of delivery period shall be made in writing before expiry of the original delivery period and shall be subject to approval by the competent authority
Delay in Delivery In case of delay attributable to the supplier, liquidated damages/other contractual action may be imposed as per the applicable Government procurement rules and the terms of the Purchase Order
Payment Payment shall be released after satisfactory delivery, inspection and acceptance of the chemicals, submission of the required invoice and other documents, subject to applicable Government financial rules
Eligibility of Supplier The bidder shall possess the necessary registration licences and statutory approvals required for supply of the chemicals offered The supplier shall furnish applicable GST registration PAN and other documents required by the Department
Manufacturer/Authorised Dealer Where required by the tender, the bidder shall be an authorised manufacturer/dealer/distributor of the offered chemicals and shall furnish appropriate authorisation/documentary evidence
Brand/Equivalent Product Where a particular make/brand is specified for technical reasons the reason shall be recorded in the procurement file and the applicable Government procurement provisions shall be followed Where equivalent products are permitted the bidder shall clearly specify the manufacturer, product code, grade and technical specifications of the offered product
Reference Standards and Certified Materials For certified reference materials, standards or reagents requiring traceability the supplier shall provide the relevant certificate assigned value uncertainty/traceability information and validity/retest information, wherever applicable
Calibration/Analytical Requirements Chemicals and reagents intended for preparation of standards calibration solutions or quantitative analysis shall meet the analytical requirements specified by the Soil Health Laboratory
No Change Without Permission The supplier shall not change the manufacturer product grade concentration pack size or specification after award of the Purchase Order without prior written permission of the competent authority
Short Supply Any shortage noticed at the time of receipt or inspection shall be made good by the supplier without additional cost
Risk and Responsibility The supplier shall remain responsible for the goods until satisfactory delivery and acceptance by the authorised officer, subject to the terms of the Purchase Order
Integrity and Compliance The supplier shall comply with applicable Government procurement requirements relating to integrity, conflict of interest, anti-corruption measures, eligibility and other statutory requirements
Termination The Department reserves the right to cancel/terminate the Purchase Order or take other contractual action in accordance with applicable rules if the supplier Fails to supply within the stipulated period without valid justification Repeatedly supplies non-conforming material Supplies counterfeit/adulterated material Violates material terms of the Purchase Order or Furnishes false or misleading information
Dispute Resolution Any dispute arising out of the procurement shall be dealt with in accordance with the dispute-resolution provisions applicable to the Government contract and the competent authoritys jurisdiction that is in Sirsi Uttara Kannada district, Karnataka state
Right of the Competent Authority The competent authority reserves the right to accept or reject any or all bids, in whole or in part, and to cancel the procurement process in accordance with applicable Government rules, without being bound to accept the lowest quotation where the prescribed requirements are not met
Special Condition for Soil Health Laboratory Since the chemicals are intended for soil testing and analytical determination, quality, grade, purity and suitability for the specified analytical method shall take precedence over merely quoting the lowest price. The supplier shall ensure that the supplied chemicals are suitable for the intended laboratory analysis and conform to the technical specifications prescribed by the Department
Documents to Accompany Supply Each consignment shall be accompanied, wherever applicable, by Tax invoice, Delivery challan, Certificate of Analysis, Safety Data Sheet/MSDS, Manufacturers product certificate, Batch/Lot details, Warranty/guarantee certificate, where applicable, and Any other document specified in the Purchase Order
