Contract Bidding Open For Tender for Supply of Needles and Syringes - 2023-24 and 2024-25 FOR ANIMAL HUSBANDRY DIRECTORATE in BIHAR

1. All the tender documents along with the enclosures should be signed at the bottom by the tenderer in each page with date.

2. Capital letters should be used in filling up of the tender form and should be neatly typed/computerized.

3. All corrections, additions, alterations in the tender documents shall be authenticated by initial/ signature of the bidder.

4. Rates should be quoted on the prescribed tender form (Annexure V). The rates offered should be written both in figures and in words and no erasing, cutting or overwriting shall be entertained.

5. All information in these tender documents shall be in English only.

6. Bidder, if desires may cite the Brand name in addition but not as a replacement of generic name.

7. Tendering firm should not quote any item which they have no endorsement in their MANUFACTURING LICENSE. In case of quoted items from overseas manufacturers/MNCs, it is required to submit an undertaking to furnish the manufacturing license before awarding of purchase order, if selected.

8. The rate to be quoted by the bidder should be F.O.R. destination at the offices of District Animal Husbandry Officers under the department inclusive of transportation charges and any other charges (Excluding applicable tax). The rate should be quoted in Indian currency only. It is necessary that specific brand, make etc. should be clearly mentioned on the tender paper furnished to compare the composition and the rate against multiple offers.

9. The bidder must quote the rate of the items for which they have been specifically asked for as per tender schedule. Bidder quoting the rates different from those mentioned in the tender schedule may be liable to be rejected. Tender containing clerical error/typographical error/arithmetical mistake (s) may be liable to be rejected.

10. Bidder who are manufacturers of the needles and syringes to be supplied by them must furnish attested copy of the certificate from the appropriate licensing authority along with the tender documents confirming that they are actually manufacturing these needles and syringes.

11. The bidders shall quote the tender price at Col.-09 of Annexure-V, which shall be inclusive of transportation Charges and any other charges (Excluding applicable Tax). The GST should be charged as per the Government guidelines.

12. The bidder is required to submit detail brochures & leaflets in respect of the items of needles and syringes offered in the Tender along with the Technical bid and produce at least two pieces of the sample for scrutiny by the Purchase Committee, failing which the items so offered will not be considered. The samples of the successful bidders received shall be kept as ?Master Sample? for verification against the supplied items.

13. The price preference for S.S.I. units located inside the state of Bihar will be given in accordance with the Government industrial Policy/Resolution in vogue. The bidder who are S.S.I. units should submit relevant documents from the competent authority along with the tender documents stating the Permanent Registration number and Date and the names of the items for which registered. The words S.S.I. unit located inside the state of Bihar should be marked in Red Ink on the right-hand top corner of the Tender documents.

14. The Tender filled by the proprietorship concerns should be signed by - the sole proprietor or by the managing partner in case of Partnership firm or by Managing Director or Board of Directors along with the authorization by means of Board of resolution in case of company. or by a person having valid power of attorney on behalf of competent authority in respect to file tenders and to execute all requisite deeds. In case of Partnership firm, the copy of partnership deed to be submitted duly attested by Gazetted Officer. Copy of the Certificate of incorporation should be furnished in support of the firm being registered under the companies Act.

15. Submission of more than one Tender by a particular bidder under different names is strictly prohibited. In case it is found later on that this condition has been violated, all the tenders submitted by such bidder would be rejected or cancelled and Earnest Money and/or Security Deposit forfeited to Government in addition to such legal action will be taken as deemed fit and proper.

17. Each page (Serially page marked with indexing) of tender documents besides the places specified should be signed by the bidder or their authorized representative. All signatures should be dated.

18. Submission of Tender by any other means will not be accepted.

19. The bidder shall quote rates which shall remain valid for acceptance for financial year 2023-24 and 2024-25 or till finalization of the next tender whichever is earlier. If adoption of next approved list is delayed beyond financial year 2024-25, the terms, conditions and the approved price of the items in the approved list may be extended for a period as desired by the Director, Animal Husbandry, Bihar on recommendation of the Purchase Committee.

20. THE DEPARTMENT PURCHASE COMMITTEE/TENDERING AUTHORITY/ UNDERSIGNED RESERVE THE RIGHT: a. To reject any / or all the Tenders at any stage without assigning any reason there of and not to accept the lowest Tender. b. To invite fresh offers from the open market or negotiate with other bidder quoting higher rate to come down to the lowest rate of the item offered by the competitors in the tenders. c. To purchase NEEDLES AND SYRINGES at the approved rate of the catalogue from any outsider during the Tender/Contract Period in case of emergency, if the bidder fail to supply such items on short notice or stops supplying on any other matter. d. To withdraw the item from the tender at any stage. In such contingency the selection of such item already made in favour of any tenderer shall be treated as cancelled. e. Not to give price preference to bidder in compliance with the existing orders issued by this State Government at the discretion of the Purchase Committee. f. To procure the item of the tender directly from State/Central Govt. Undertaking firms even if a tender of other parties for the same item has been offered/ accepted/approved. g. To make additions to or deletion from the list of consuming units/delivery points to any time during the period of validity of the tender or of the contract in pursuance of the Tender. h. To process the tender groups separately.

21. Approval of items of successful bidder will be notified/issued by the authority in due course. On receipt of such information, the successful bidder(s) has to execute an Agreement on Indian non judicial stamp paper of appropriate denomination (as stipulated by the State Govt. of Bihar) and also required to furnish the performance security deposit @ 5% of contract value in the form of Bank Guarantee of any commercial bank in favour of Director, Animal Husbandry, Bihar, Patna & payable at Patna only.

22. The specification and quantity of the item needed as mentioned in the tender notice is tentative and is subject to increase/decrease as per the availability of fund. The payment would be made for actual supply taken and no claim in this regard should be entertained otherwise.

23. The Supply Order to the successful bidder will be given by the Director, Animal Husbandry, Bihar. In case the successful bidder (L1) is unable to supply the item(s) in requisite quantity within stipulated time as mentioned in the supply order, for smooth and uninterrupted supply, the supply order may be distributed to more than one party on approved rate. Apart from it, a penalty @3% of the total value of delayed supply will be imposed on the supplier. Payment to the supplier will be made after deduction of penalty amount. The decision of Director, Animal Husbandry, Bihar will be final in this regard.

24. The successful bidder will have to supply the item(s) to the offices of the District Animal Husbandry Officers under the department in accordance with the conditions mentioned in the Tender Notice, Agreement and Supply Order. Physical verification of the supplied item(s) will be done by an officer authorized by concerned Regional Director, Animal Husbandry for this purpose. Copy of quality test report of the Needles and Syringes being supplied must be submitted to the concerned District Animal Husbandry Officers and the Director, Institute of Animal Health & Production, Bihar, Patna along with supply. Delivery challan in triplicate must be submitted along with the consignment. One copy of the challan should be submitted to the office of the concerned District Animal Husbandry Officer another copy should be submitted to the office of the Director, Institute of Animal Health & Production, Bihar, Patna and the third copy should be retained by the supplier.

25. Payment against all the accepted supplies will be made by the Director, Institute of Animal Health & Production, Bihar, Patna. No payment will be made before completion of supply.

26. The period of firmness of the approved rates is financial year 2023-24 and 2024-25. However, if at any time during the period of contract, the price of any tendered item is reduced or brought down by any law or act of the Central or State Government or the bidder, the bidder shall be morally and statutorily bound to inform the Director, Animal Husbandry, Bihar immediately about such reduction in the contract price. The Director, Animal Husbandry, Bihar is empowered to unilaterally effect such reduction as is necessary in rate, in case the bidder fails to notify or fails to agree for such reduction of rate.

27. If the performance of the approved firm is found to be not satisfactory for irregular supply of approved items against indents placed during the validity period of the tender, the Earnest/Security Money deposited by the approved firm will not be released and the Security Money shall be decided by the competent authority to be forfeited. The tender of the firm will not be entertained in future.

28. The Earnest Money Deposit furnished by the bidder will liable to be forfeited, if the bidder withdraws his tender as a whole or for any particular item at any stage after the submission of the tender or fails/refuses to enter into written agreement for any/or all other items of his accepted tender within the time specified when requested to do so or refuses to deposit Security Deposit. The Security Deposit/Earnest Money Deposit furnished by a bidder and even the tender is liable for forfeiture and cancellation without prejudice to any other action in the event of failure/refusal to supply order and or according to contract specification quality and/or quantity.

29. PACKAGING: All the packaging should be primary (New). The supplier shall provide such packaging of the goods as is required to prevent their damage or deterioration during transit to their final destination. The packaging should be sufficient to withstand without limitation rough handling during transit & open storage. The manufacturing date, batch no. etc. must be disclosed on the body of the packages. Strips of the supplied Needles & Syringes should be labelled as ?For Government of Bihar use-Not for sale?. The expiry date should be mentioned on the strip of the Needles & Syringes pack and body of the bills. The expiry period should be a minimum of 24 months (two years) from the date of supply, which may be reduced by the competent authority of the department as and when required on the basis of the field situations and requirement for utilization. The deviation if any in this regard must be reported before Purchase Committee and Director.

30. All the supplies should invariably display the particulars on its label and/or carton in a distinct manner.

31. Abnormally low price of an item quoted by the bidder in the Tender with some malafide intention will not be accepted, if detected and his offer will be rejected.

32. Bidder shall not be permitted to alter or modify their bids after expiry of the dateline for receipt of bids.

33. In exceptional cases where the price negotiation is necessary due to some unavoidable circumstances, the same may be resorted to only with the lowest evaluated responsive bidder.

34. If any situation arises, where the lowest evaluated responsive bidder is not in a position to supply the full quantity required, the remaining quantity, as far as possible, be ordered on the next higher responsive bidder(s) at the rate offered by the lowest evaluated responsive bidder, on the specific recommendation of the Purchase Committee. Further, in case of emergency need when inconvenience to the public service is caused for delay in the process of procurement, Director may go for purchase as per provision of Bihar Financial Rules.

Bidders shall submit (along with their Bids) EMD in the form of a Bank Guarantee in favour of ?Director, Animal Husbandry, Bihar payable at Patna and should be valid for 6 months. No interest shall be payable on Bid Security under any circumstance. Bidders can also make the EMD payment through online at eproc2site. Scanned copy of BG shall be uploaded online and original copy shall be submitted in the Directorate of Animal Husbandry, Bihar before the stipulated date and time.

Bidder should need to calculate EMD amount as per financial sheet and make Bank Guarantee as per the participated items
