Agency should possess authentic license / Registration certificate issued by the competent government authority for award of security services. Labour Department. If license is expired, renewed license shall be enclosed, that is in Form C with number of persons employed is more than 100.

The agencies should have Experience in the relevant field GOK/GOI/ Semi Govt. undertakings / Govt. Institutions like Universities etc., Enclose the copy of service certificate from the client, work orders will be not considered. The value of such service should not be less than Rs.33.00 Lakhs in any one year for last five year 2020-21, 2021-22, 2022-23, 2023-24 and 2024-25.

The Agency / bidder should exhibit Financial Capability in the form of Line of credit / Solvency certificate for Rs. 20.00 lakhs issued any nationalized / scheduled Bank in the name of COMPTROLLER, UHS, BAGALKOT. The line of Credit shall be for the subject work.

The agency shall submit the turn over certificate of the last Five years i.e., 2020-21, 2021-22, 2022-23, 2023-24 and 2024-25 duly certified by the chartered accountant. The financial turnover shall be minimum of Rs. 66.00 Lakhs in any one year in the last Five years i.e. 2020-21, 2021-22, 2022-23, 2023-24 and 2024-25. Turnover issued shall be specifically for rendering man power service.

The agency should have the license from the police department as per the rules of private security agencies, regulation act 2005 and Karnataka private security agencies rules 2008.

Eligibility Criteria

1

The financial bid of those agencies shall be opened who are eligible in technical criteria and points scored in Annexure-I.

2

It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of e-Procurement on or before the last date and time of bid submission.

EMD Payments through e-Payment mode shall be made as one single transaction and payments made in part are liable for rejection.

Take home salary for the guards must be as per the minimum wages &should be paid compulsorily through account pay/cheque, apart from this, the PF & ESI shall be paid by the agency as per prevailing rule. The agency shall submit the bank voucher statement of every month.

If the service charges quoted by the agency is below or Equal to 3.85% such bids will be rejected.

The minimum qualification of the Security guard must be 10th standard and Security Supervisors must be PUC and sweepers must be 7th.

GST must be paid to the government by the agency and the challan must be produced in the next bill, failing which payment will not be done and the agreement stands cancelled.

Tax deduction at source will be done according to the Prevailing rules.

The successful agency shall make agreement in a stamp paper of Rs. 800/- in the name of the ESTATE OFFICER, UHS, Bagalkot.

The service will be engaged from date of work order, for 12 months. Extendable for 9 months by mutual consent with same terms and condition of agreement executed.

The service will be accepted for 3 months on trial basis and will be continued for the remaining period, only if the service proves to be satisfactory. If agency fails to extend good service, the Estate officer holds all rights to cancel the agreement without prior intimation. (The service of agency will be continued after completion of regular period of 12 months if needed up to 9 months after expiry of service).

The technical strength of agency is as per evaluation criteria.

The guards appointed by the agency and the supervisors must follow the S.S.A regulations.

Service will be temporary. Request for permanent appointment will not be entertained.

The tender inviting authority (University) reserves the right to reject any or all Tenders without assigning any reason.

The documents to be uploaded must be attested by the gazetted officer / Notary.

Provident Fund of the employee and employer must be deposited in separate account every month and the details must be submitted to this office.

Negotiation if need be will be held for the quoted prices after acceptance of the lowest bidder.

The agency will solely be held responsible for the damages / deaths, injuries caused to the staff deployed during the period of service.

The payment of supervisor, guard and sweepers must be as per prevailing minimum wages declared by labour department for service rendered to the University, from time to time.

Employer has right to reject the services at any time during their tenure without assigning any reason.

If agencies have quoted same service charge, then bidder will be selected as per their maximum average turnover for the last Five years of the bidder.

The agency shall abide by the rules which will be revised time to time.

In the event of any disputes, the decision of Honble Vice-Chancellor is final and binding on the agency.

University may require the additional number of security guards and supervisors for deployment at various points during the cultural / other events of the university. The agency shall submit the separate bill for the service provided.

The security services will be in three shifts, commencing from 9.00 am to 5.00 pm, 5.00 pm to 1.00 am and 1.00 am to 9.00 am and shall be fixed by the university depending upon the requirement.

The financial bid of unsuccessful agencies in the technical qualification will not be opened and will not be considered for the further process of tender.

The successful tenderer has to deposit 5% of contract price as security deposit before execution of agreement, in the form of FDR from Nationalized /scheduled bank drawn in favor of Comptroller, U.H.S Bagalkot (No interest will be paid for this).

The security deposit will be forfeited in the event of breach of any of the terms and conditions of this contract by agency / contractor

Agency shall provide uniformed and trained personnel & use its best encleavor to provide security services to the university for providing safety monitoring & surveillance.

Rates quoted by agency will include all statutory obligations of the contractor under minimum wages act, contract labour (R & A) act, weekly off replacement charges, cost of uniform of personnel deployed by the contractor, all kinds of taxes, service charges, etc of the agency.

The number of security guards may vary as per actual requirement.

The agency shall disburse the wages to its staff deployed in the university every month through ESC or by cheque.

The university shall not be responsible for providing residential accommodation to any of the security guards / supervisors.

Agency should provide suitable arrangement for communication between Supervision guard.

The agency shall bear all the expenses incurred on the following items i.e., provision of torches and cells, lathis / ballams and other implements to security staff, stationary for writing duty charts and registers at security check point and records keeping as per requirement.

Security staff engaged by agency shall not take part in any staff union and association activities.

Only physically fit personnel shall be deployed for duty, if not university has right to suspend.

The agency shall ensure to provide at least one female security guard in each shift in emergency.

The agency shall not employ any person below the age of 18 years and above the age of 45 years. Manpower so engaged shall be trained for providing security services & fire fighting services before joining.

The agency shall have his own establishment / setup / mechanism etc at his own cost to ensure correct & satisfactory performance of his liabilities & responsibilities under the contract.

Any damage or loss caused by agency persons to the university in whatever form would be recovered from the agency.

All liabilities arising out of accident or death while on duty shall be borne by the agency.

The security guards / supervisors should be in neat and clean uniform (Including proper name badges) failing which invites a penalty of Rs. 500/ each occasions / shift.

Any losses due to theft in the campus should be borne by the agency (50%) of the estimate value.

The Employer is the University and Employee is the agency.

The Contractor / Agency shall comply with the provisions of the Workmans Compensation Act, 1923, the payment of Wages Act 1936, the minimum Wages Act 1943, employment of Children Act, 1938. Employers Liability Act 1938 and other acts Central or State that may be applicable to him / them. He shall be liable to pay all such sum or sums that may become payable as contribution, compensation, penalty, fine or otherwise at his cost and the University will not make good under any circumstances.

The University shall have the right to withhold payment of or make recoveries for claims due under the contract in respect of any loss or damage caused or occasioned in respect of the properties of the University under the terms and conditions of this arrangement or any payment necessitated due to infringement of any statutory obligations by the Contractor / Agency.

The Contractor / Agency shall not transfer or sublet the work to any on without the prior written approval of the University. The agency shall either by himself / themselves or through a competent agent approved by the University perform the said work.

The percentage quoted by agency for the entire period of contract / extension thereon if any and are inclusive of all taxes, duties, statutory levied, whether Central or State and are not subject to any revision. No increase in rates or extra payment will be allowed on any account. Increase in cost of materials, labour due to levy of new statutory levies under Central / State Acts, or enhancement of such existing levies, subsequent tendering shall be met by the Agency and will not be met by the University on any account.

The University (Employer) will pay only the employer contributions for EPF, ESI, service charges and GST as per prevailing rules and the employee (agency) has to pay his contributions for ESI & EPF from time to time paid challan should be submit to this office every month.

The University has the authority to revise service rates and service conditions any time during the lease period.

If any accident / death while the outsourced employees (Persons who is working under agency) are working, the agency is solely responsible.

If legal matters arising out of outsourcing related service, Civil Court Bagalkot and other courts with in Bagalkot jurisdiction only.

The service charge to be quoted by the agency shall be only to Basic plus VDA (Service charge will not be paid for PF / ESI and GST amount).

The agency should be covered under all statutory requirements like ESI, PF etc., by the Agency and the Agency shall comply with all the formalities in this regard. Copy of challen and Schedule of Agency for payment of ESI / PF / ELI etc. shall enclose with all (whether running / monthly or final) bills, will have to submit.

The bidders shall quote only service charges per head per month in percentage (%) over minimum wages.

If there are any quarries from agency, a letter has to be emailed to this office well before 1 day of date of pre bid meeting.

The bidders are informed to visit e-procurement portal for KC-2 manual and are abide to conditions laid in the manual from time to time.

The agency shall see all corrigendum / addendum.

Cleaning work has to be completed before working hours of university offices.

The workers provided should behave courteously with the university staff.

Contract workers are never employees of the university and they are not given any form attendance and experience certificate to any such workers.

The successful bidder/agency shall strictly implement and comply with the reservation policy in all outsourcing recruitments and deployments under this contract, in accordance with the Government of Karnataka, Department of Personnel and Administrative Reforms (DPAR) Circular dated 20.05.2024. The agency must mandatorily fulfill and follow all guidelines, terms, and conditions specified in the aforementioned circular during the entire tenure of the contract.
