01.Any objections by the participating bidders on the technical bid evaluation / disqualification made by the tender inviting authority shall be made before of opening of price bid (Date mentioned in NIT) and proper acknowledgement shall be obtained invariably. The representation / petition received after the specified time and date shall not be entertained. 02.The tenderer shall furnish the declaration that: 1) They have not been black listed in any department due to any reasons. 2) They have not been demoted to lower category in any department for not filing the tenders. 3) They will agree to get disqualified themselves for any wrong declaration in respect of the above and get their tender summarily rejected. 4) The soft copies uploaded by them are genuine. Any incorrectness/deviation noticed will be viewed seriously apart from cancelling the work duly forfeiting the Bid security. 03.The tender inviting authority reserves the right to reject any or all the tenders without assigning any reasons thereof. 04.The tender inviting authority reserves the right to amend or modify the tender and its conditions before bid submission closing date & time of tender. 05.Any other condition regarding receipt of tenders in conventional method appearing in the tender documents may please be treated as not applicable. 06.The bidders have to upload the information preferably in .PDF format. 07.Only the Successful Bidder should submit the Hard Copies before entering into agreement. 08.The quantities mentioned in the BoQ are only indicative and may vary depending on actual requirement. 09.Bids shall remain valid for a period of 90 (ninety days) from the last date of bid submission. The bid validity period may be extended on mutual consent. 10.Any certificate or mandatory document or license or any other mandatory documents obtained after publication of this tender is not acceptable.The machinery self declaration on Rs.100.00 non judicial stamp paper shall be in the given format duly mentioning the Name of the work and NIT number. All other format are not accepted for evaluation. 11.Prospective bidders are suggested to visit the worksite before participating tender and shall get themselves thoroughly acquainted with the local site condition. It is advised that they conduct a demographic study to identify the local utility areas (markets, locality, communication and transportation conditions, labor and materials availability), which will help the bidders. 12.The bidder can download the tender at free of cost. 13.Even during the execution of the work, if it is found that the contractor had produced false / fake certificate or document pertaining to qualification criteria or any other aspect he / she / firm will be blacklisted and his / her / its contract will be terminated. 14.No tender shall bar any cause of action or claim against any officer of the department. 15.Tenders up to 15% less than the estimate rates may be accepted; but for tenders which are less by more than 15%of the estimate, a DD for the difference between the tendered amount and 85% of the estimate contract value should be taken so that tenderer leaves the work midway and department is forced to call for tenders for the work once again, the DD shall be used to finance the re-tendered work. 16.Errors in tender document: While all efforts have been made to avoid errors in preparation of tender documents, the bidders are advised to check the same carefully. No claim on account of any error detected in the tender document shall be entertained. 17.Apart from the Bid Security (EMD) the tenderer shall be liable to pay transaction fee, processing fee and e-corpus fee (in case of L1) 18.The eligibility of contractor for the work will be reckoned as per Government orders mentioned in the General terms and conditions / eligibility. Further, 19.The prospective bidder shall own/lease key and critical equipment . The prospective bidder shall submit / upload ownership declaration on Rs.100.00 non judicial stamp paper. Further, the prospective bidder shall upload a owner ship certificate (along with lease agreement if required) which was certified by the not below the rank of the Executive Engineer of any department, 20. 21.The prospective bidder shall upload, a self declaration on ownership/lease of key and critical equipment (as mentioned in the SBD) on Rs.100.00 non judicial stamp paper and suggested that, the bidder shall clearly mention the NIT No. and name of the work. 22.The ECV of the work is Rs.3611864.00 23.The 1% EMD for the work is Rs.37,000. The payment 1% EMD allowed as per GOMs.No.14, IT & EC Deptt, dt. 18-09-2017 & GOMs.No.15, IT & EC Deptt, dt. 29-09-2017. 24. The balance EMD @ 1ยฝ% of ECV / TCV whichever is higher shall be paid at the time of concluding Agreement by the successful Bidder. 25.The processing fee for the work is Rs.4000.00. The bidder shall remit the fee through online (SBI ZPP A/c No.37342596656 IFSC Code SBIN0020780) and a copy of the remittance slip shall be uploaded. 26.The prospective bidder shall upload all the documents which are kept mandatory in the NIT. 27.The evaluation shall be done as per the GOMS.No.66, I & CAD (Reforms) Deptt. dt. 20-04-2015. 28.The acceptance or rejection of tender is, however, left entirely to the discretion of the officer to whom the duty is entrusted and no tenderer can demand the cause of rejection of his offer as per GOMs.No.773,PWD, dt. 05-06-1971.
