1. The purpose of this RFP is to provide interested parties with information that may be useful to them in making their key submissions, technical and Business proposal to this RFP.

2. Darbhanga Municipal Corporation, Darbhanga also accepts no liability of any nature whether resulting from negligence or otherwise howsoever caused arising from reliance of any Bidder upon the statements contained in this RFP.

3. Darbhanga Municipal Corporation, Darbhanga reserves the right to cancel the NIT as whole or in part without assigning any reason whatsoever.

4. Darbhanga Municipal Corporation, Darbhanga may in its absolute discretion, but without being under any obligation to do so, update, amend or supplement the information, assessment or assumptions contained in this RFP.

5. The issue of this RFP does not imply that the Authority is bound to select a Bidder or to appoint the Selected Bidder or Concessionaire, as the case may be, for the Project and the Authority reserves the right to reject all or any of the Bidders or Bids without assigning any reason whatsoever.

6. The bidders are encouraged to conduct their own independent survey, assessment, analysis and check the reliability, accuracy, feasibility and completeness before submission of their interest/proposal.

7. Bidders should submit their response in the given formats provided for submission, not conforming to the instructions or prescribed formats will be summarily rejected.

8. Bidders should equip themselves with all the permits, license, statutory clearances etc. required for executing the project.

9. Bidder should adhere to all the safety guidelines and norms while executing the project.

10. The Bidder shall bear all its costs associated with or relating to the preparation and submission of its Bid including but not limited to preparation, copying, postage, delivery fees, expenses associated with any demonstrations or presentations which may be required by the ULB or any other costs incurred in connection with or relating to its Bid. All such costs and expenses will remain with the Bidder and the ULB shall not be liable in any manner whatsoever for the same or for any other costs or other expenses incurred by a Bidder in preparation or submission of the Bid, regardless of the conduct or outcome of the Bidding Process.

11. The Authority has adopted a two stage selection process (collectively the ?Selection Process?) for evaluating the Proposals comprising of technical bids and financial bids to be submitted by the Applicant. For avoidance of doubt, the technical proposal shall be submitted in hard copy to the Authority Address and in soft copy online through e-procurement portal and the financial proposal shall be submitted only online through e-procurement portal. The selection will be done through LCS method (Least Cost Based Selection). In the first stage, a technical evaluation will be carried out as specified in this RFP. Based on this technical evaluation, a list of successful applicants shall be prepared. In the second stage, a financial evaluation will be carried out as specified. Proposals will finally be ranked according to their financial scores as lowest price bid will be declared L1 and then L2, L3 subsequently.
