INSTRUCTIONS TO BIDDERS A. GENERAL 2.1 General terms of Bidding 2.1.1 No Bidder shall submit more than one Bid for the Project. A Bidder shall not be entitled to submit another BID. 2.1.2 Any Bidder shall ensure that Power of Attorney is legalised/apostille by appropriate authority notarised in the jurisdiction where the Power of Attorney is being issued and requirement of Indian Stamp Act is duly fulfilled. 2.1.3 The Techno Economic Feasibility Report (TEFR) of the Project is being provided only as a preliminary reference document by way of assistance to the Bidders who are expected to carry out their own surveys, investigations and other detailed examination of the Project before submitting their Bids. Nothing contained in the Techno Economic Feasibility Report (TEFR) shall be binding on the Authority nor confer any right on the Bidders, and the Authority shall have no liability whatsoever in relation to or arising out of any or all contents of the Techno Economic Feasibility Report (TEFR). 2.1.4 Notwithstanding anything to the contrary contained in this RFP, the detailed terms specified in the draft concession agreement shall have overriding effect; provided, however, that any conditions or obligations imposed on the Bidder hereunder shall continue to have effect in addition to its obligations under the Concession Agreement. 2.1.5 The Bid shall be furnished in the format exactly as per Appendix-I i.e. Technical Bid as per Appendix IA and Financial Bid as per Appendix IB. Bid percentage shall be indicated clearly in both figures and words, s, in prescribed format of Financial Bid and shall be signed by the Bidder?s authorised signatory. In the event of any difference between figures and words, the amount indicated in words shall be taken into account. If the percentage quoted by a tenderer is found to be either abnormally high or within the permissible ceiling limits prescribed but under collusion or due to unethical practices adopted at the time of tendering process, such tenders shall be rejected. 2.1.6 The Bidder shall deposit a Bid Security of Rs. 4.53 Crore (Rupees Four Crore Fifty Three Lakh only) in accordance with the provisions of this RFP. The Bidder has the option to provide the Bid Security as of irrevocable Bank Guarantee in favor of the Commissioner, MTMC , as per format at Appendix-II (or) Irrevocable valid and enforceable Insurance Surety Bond in favor of Commissioner, MTMC issued by any Insurance Company registered under Insurance Act amended from time to time and approved by the Insurance Regulatory Development Authority of India (IRDA) as per the format at Appendix- V (or) online payment using Net banking/RTGS/NEFT from their registered bank accounts only or using Credit Card / Debit Card from Nationalized Bank or any Scheduled commercial bank, as per the VISA/ MASTER Card Guidelines. The issuing Bank/Insurance Company shall ensure that the instrument is not invoked or liquidated without prior written consent of the Authority. The Bidders shall also make online payment towards cost of bid document of Rs. 25,000/- + GST (Rupees Twenty Five thousand only) transmitted online to ATPS as per Cl. 1.2.1 of this RFP. 2.1.7 The validity period of the Insurance Surety Bond, Account Payee Demand Draft, Fixed Deposit Receipt, Banker?s Cheque or Bank Guarantee (including e-Bank Guarantee), as the case may be, shall not be less than 120 (one hundred and twenty) days from the Bid Due Date with a claim period of 60 (Sixty) days, and may be extended as may be mutually agreed between the Authority and the Bidder. The Bid shall be summarily rejected if it is not accompanied by the Bid Security. The Bid Security shall be refundable no later than 90(ninety) days from the Bid Due Date. except in the case of the Selected Bidder whose Bid Security shall be retained till it has provided a Performance Security under the Agreement. 2.1.8 The Bidder should submit a Power of Attorney as per the format at Appendix-III, authorising the signatory of the Bid to commit the Bidder. 2.1.9 Deleted. 2.1.10 Any condition or qualification or any other stipulation contained in the Bid shall render the Bid liable to rejection as a non-responsive Bid. 2.1.11 The Bid and all communications in relation to or concerning the Bidding Documents and the Bid shall be in English language. 2.1.12 The Bidding documents including this RFP and all attached documents, provided by the Authority are and shall remain or become the property of the Authority and are transmitted to the Bidders solely for the purpose of preparation and the submission of a Bid in accordance herewith. Bidders are to treat all information as strictly confidential and shall not use it for any purpose other than for preparation and submission of their Bid. The provisions of this Clause 2.1.12 shall also apply mutatis mutandis to Bids and all other documents submitted by the Bidders, and the Authority will not return to the Bidders any Bid, document or any information provided along therewith. 2.1.13 This RFP is not transferable. 2.1.14 Any award of Project pursuant to this RFP shall be subject to the terms of Bidding Documents. 2.1.15 Where the Bidder is a single entity, it shall be required to form an appropriate Special Purpose Vehicle, incorporated under the Indian Companies Act 2013 (the ?SPV?), to execute the Concession Agreement and implement the Project. 2.1.16 Any entity which has been barred by the Central/ State Government, or any entity controlled by it, from participating in any project (BOT or otherwise), and the bar subsists as on the date of Bid, would not be eligible to submit a Bid. 2.1.17 A Bidder including any Associate should, in the last 3 (three) years, have neither failed to perform on any contract, as evidenced by imposition of a penalty by an arbitral or judicial authority or a judicial pronouncement or arbitration award against the Bidder, Associate, as the case may be, nor has been expelled from any project or contract by any public entity nor have had any contract terminated any public entity for breach by such Bidder, Associate. Authority would place sole reliance on the certification provided by the Bidder in this regard in its letter comprising the Technical Bid. 2.1.18 In computing the Net Worth of the Bidderunder Clauses 2.2.2 and 2.2.4, the Net Worth of their respective Associates would also be eligible hereunder. For purposes of this RFP, Associate means, in relation to the Bidder, a person who controls, is controlled by, or is under the common control with such Bidder (the ?Associate?). As used in this definition, the expression ?control? means, with respect to a person which is a company or corporation, the ownership, directly or indirectly, of more than 50% (fifty per cent) of the voting shares of such person, and with respect to a person which is not a company or corporation, the power to direct the management and policies of such person by operation of law. It is clarified that a certificate from a qualified external auditor who audits the book of accounts of the Bidder shall be provided to demonstrate that a person is an Associate of the Bidder as the case may be. 2.1.19 The following conditions shall be adhered to while submitting a Bid: (a) Bidders should attach clearly marked and referenced continuation sheets in the event that the space provided in the prescribed forms in the Annexes is insufficient. Alternatively, Bidders may format the prescribed forms making due provision for incorporation of the requested information; (b) information supplied by a Bidder must apply to the Bidder, Member or Associate named in the Bid and not, unless specifically requested, to other associated companies or firms; (c) in responding to the RFP submissions, Bidders should demonstrate their capabilities in accordance with Clause 3.1 below; and 2.1.20 Deleted 2.1.21 Notwithstanding anything to the contrary contained herein, in the event that the Bid Due Date falls within three months of the closing of the latest financial year of a Bidder, it shall ignore such financial year for the purposes of its Application and furnish all its information and certification with reference to the 5 (five) years or 1 (one) year, as the case may be, preceding its latest financial year. For the avoidance of doubt, financial year shall, for the purposes of an Application hereunder, mean the accounting year followed by the Applicant in the course of its normal business. 2.1.22 Deleted 2.1.23 Deleted 2.1.24 All Orders of Ministry of Finance/DPIIT/any other Government agencies, as applicable and prevalent on the date of LOA, shall be applicable. 2.1.25 Deleted 2.2 Eligibility and qualification requirements of Bidder 2.2.1 For determining the eligibility of Bidder the following shall apply: (a) The Bidder should be a single entity.The term Bidder used herein would apply to a single entity. (b) Deleted. (c) A Bidder shall not have a conflict of interest (the ?Conflict of Interest?) that affects the Bidding Process. Any Bidder found to have a Conflict of Interest shall be disqualified. In the event of disqualification, the Authority shall be entitled to forfeit and appropriate 5% of the value of the Bid Security or equivalent amount from the Performance Security, as the case may be, as mutually agreed genuine pre-estimated loss and damage likely to be suffered and incurred by the Authority and not by way of penalty for, inter alia, the time, cost and effort of the Authority, including consideration of such Bidder?s proposal (the ?Damages?), without prejudice to any other right or remedy that may be available to the Authority under the Bidding Documents and/or the Concession Agreement or otherwise. Without limiting the generality of the above, a Bidder shall be deemed to have a Conflict of Interest affecting the Bidding Process, if: (i) The Bidder or Associate (or any constituent thereof) and any other Bidder, its Associate thereof (or any constituent thereof) have common controlling shareholders or other ownership interest; provided that this disqualification shall not apply in cases where the direct or indirect shareholding of a Bidder, its Associate thereof (or any shareholder thereof having a shareholding of not more than 25%(twenty five percent) of the paid up and subscribed capital; of such Bidder Associate, as the case may be) in the other Bidder, its Associate, is not more than 25% (Twenty five percent) of the subscribed and paid up equity share capital thereof; provided further that this disqualification shall not apply to any ownership by a bank, insurance company, pension fund or a public financial institution referred to in section 4A of the Companies Act, 1956/2013. For the purposes of this Clause 2.2.1(c), indirect shareholding held through one or more intermediate persons shall be computed as follows: (aa) where any intermediary is controlled by a person through management control or otherwise, the entire shareholding held by such controlled intermediary in any other person (the ?Subject Person?) shall be taken into account for computing the shareholding of such controlling person in the Subject Person; and (bb) subject always to sub-clause (aa) above, where a person does not exercise control over an intermediary, which has shareholding in the Subject Person, the computation of indirect shareholding of such person in the Subject Person shall be undertaken on a proportionate basis; provided, however, that no such shareholding shall be reckoned under this sub-clause (bb) if the shareholding of such person in the intermediary is less than 26% of the subscribed and paid up equity shareholding of such intermediary; or (ii) a constituent of such Bidder is also a constituent of another Bidder; or (iii) such Bidder, its Associate thereof receives or has received any direct or indirect subsidy, grant, concessional loan or subordinated debt from any other Bidder, its Associate, or has provided any such subsidy, grant, concessional loan or subordinated debt to any other Bidder, its Member or any Associate thereof; or (iv) such Bidder has the same legal representative for purposes of this Bid as any other Bidder; or (v) such Bidder, or any Associate thereof, has a relationship with another Bidder, or any Associate thereof, directly or through common third party/ parties, that puts either or both of them in a position to have access to each other?s? information about, or to influence the Bid of either or each other; or (vi) such Bidder or any Associate thereof has participated as a consultant to the Authority in the preparation of any documents, design or technical specifications of the Project. (vii) Such Bidder or any Associate thereof has appointed any official of the Authority, Technical Advisors of Authority for the Project, Legal Advisors of Authority for the Project, Financial Advisors of Authority for the Project, dealing with the Project, within a period of 1 years from the date of award of the Project to that Bidder. Explanation: For purposes of this RFP, Associate means, in relation to the Bidder, a person who controls, is controlled by, or is under the common control with such Bidder (the ?Associate?). As used in this definition, the expression ?control? means, with respect to a person which is a company or corporation, the ownership, directly or indirectly, of more than 50% (fifty percent) of the voting shares of such person, and with respect to a person which is not a company or corporation, the power to direct the management and policies of such person by operation of law. (d) A Bidder shall be liable for disqualification and forfeiture of Bid Security if any legal, financial or technical adviser of the Authority in relation to the Project is engaged by the Bidder, its Associate thereof, as the case may be, in any manner for matters related to or incidental to such Project during the Bidding Process or subsequent to the (i) issue of the LOA or (ii) execution of the Concession Agreement. In the event any such adviser is engaged by the Selected Bidder or Concessionaire, as the case may be, after issue of the LOA or execution of the Concession Agreement for matters related or incidental to the Project, then notwithstanding anything to the contrary contained herein or in the LOA or the Concession Agreement and without prejudice to any other right or remedy of the Authority, including the forfeiture and appropriation of the Bid Security or Performance Security, as the case may be, which the Authority may have thereunder or otherwise, the LOA or the Concession Agreement, as the case may be, shall be liable to be terminated without the Authority being liable in any manner whatsoever to the Selected Bidder or Concessionaire for the same. For the avoidance of doubt, this disqualification shall not apply where such adviser was engaged by the Bidder, its Member or Associate in the past but its assignment expired or was term

Nor will this disqualification apply where such adviser is engaged after a period of 3 (three) years from the date of commercial operation of the Project. Provided further, in case the Authority seeks information / clarification from a Bidder related to occurrence / non-occurrence of Conflict of Interest and the Bidders fails to provide such information within a reasonable time, the Authority shall disqualify the Bidders Encash its Bid Security as per provision of Clause 2.20.7 (a) and further debar it from participation in any future procurement process for a minimum period of 1 year. (g) The Bidder shall be a Contractor registered in the State of Andhra Pradesh as a Civil Contractor / Contracting Firm and shall possess a valid and subsisting registration in the appropriate class, in accordance with the provisions of G.O.Ms. No. 94, I&CAD (PW-COD) Department, dated 01.07.2003, as amended from time to time by the competent authority of the Government of Andhra Pradesh. The class of registration of the Bidder shall be commensurate with the Estimated Project Cost (EPC) of the Work, as specified in the Bid Document. Bidders holding registration in a class lower than that required for the subject Work shall be considered ineligible and their Bids shall be rejected. (h) The Bidder shall have valid GST registration. In case GST registration is not in Andhra Pradesh, the Selected Bidder shall obtain GST registration in Andhra Pradesh prior to execution of the Agreement. (i) The Bidder shall submit proof of payment of Professional Tax for the previous year as per as per G.O.Ms.No.44, WR (R) Dept., Dated.09-09-2021 and as per Cir. Memo. No.ICD01-COOR/167/Reforms/2020-2, Dated. 09-09-2021. (j) Any Bidder who has applied for or availed Corporate Debt Restructuring (CDR) or Strategic Debt Restructuring (SDR) in the last 5 (five) financial years shall not be eligible. A certificate from a Chartered Accountant shall be submitted in this regard for the current financial year. 2.2.2 To be eligible for this RFP a Bidder shall fulfil the following conditions of eligibility based on GO MS.No.94, dt: 1.7.2003, GO Ms.No.372, MA&UD(K1) Dept., dated: 28-9-2012 and GO Ms.No.1, Finance Deptt, dt: 25.2.2012: (A) Technical Requirement: (i) The Bidder should meet the Minimum Quantities of items as per GO Ms.No.94, dated: 1.7.2003 for the principal components of Similar Works as given below in any one financial year during the last ten financial years ending with 2025-26. The experience certificates furnished should clearly indicate the date of commencement of the work and date of completion and payment made financial year wise. All documents uploaded by the Bidder shall bear the original physical signatures of the authorized signatory. The use of facsimile signatures, scanned/pasted signatures, or image-based signatures shall not be permitted. Any Bid found to contain such non-compliant signatures shall be liable for rejection. (B) Financial Requirement: The Bidder shall satisfy the following Financial Criteria: (i) The Bidder, shall have satisfactorily completed similar works of an aggregate value not less than Rs. 113.13 Crores (Rupees one hundred and thirteen crore thirteen lakh only) in any one financial year during the last 10 (ten) financial years ending 31.03.2026. For the purposes of this Clause: (a) ?Similar works? shall mean any Urban Utility Infrastructure Project/s viz., Gravity lines/ STP/ ETP / TTP etc., in any one Financial Year. (b) The value of completed works shall be escalated at the rate of 10% (ten percent) per annum (simple rate) to bring them to the price level of FY 2026-27. (c) Experience of Sub-Contractors or GPA holders shall not be considered. (ii) The bidder should produce liquid asset / credit facilities / Solvency certificates from any Indian Nationalized / Scheduled Banks of not earlier than April?2025 of value not less than three months cash flows required for the peak value of the construction works i.e., Rs. 56.57 Crores (Rupees Fifty six crore fifty seven lakh only). (iii) Bid Capacity: The Bidders who meet the physical and financial criteria will be qualified only if their available bid capacity is more than the estimated contract value. The bid capacity will be calculated as under: Assessed bid capacity as per formula (3AN-B) should be greater than the Estimate Project Cost as specified in the Tender Document i.e. Rs. 452.53 Crores (Rupees Four hundred fifty two crore and fifty three lakh only) where A is the Maximum value of Civil Engineering works (Annual Construction Turnover) executed in any one financial year during the last ten years. The value shall be updated at the rate of 10% (ten percent) per annum (simple rate) to bring them to the price level of FY 2026?27 (i.e., updated to current price level). N =Number of years prescribed for completion of the works for which tenders are invited i.e. 2 years. Where B is the Value of existing commitments and ongoing works to be completed during the period of completion of the project for which tenders are invited. (iv) The bidder should demonstrate the Net Worth of Rs. 113.13 Crores (Rupees one hundred and thirteen crore thirteen lakh only) as per the statutory audited documents / bank statements / CA certificates etc to satisfy the standard norms / requirements for assessing the Net Worth. 2.2.3 O&M Experience: The Bidder shall engage an experienced O&M contractor or hire or deploy qualified and trained personnel for operation and maintenance of the Project in conformity with the provisions of the concession agreement. 2.2.4 The Bidders shall enclose with its bid, to be submitted as per the format at Appendix-IA, complete with its Annexes, the following: (i) Certificate(s) from its statutory auditors1$ or the concerned client(s) stating the payments made/ received or works commissioned, as the case may be, during the past 10 years in respect of the projects specified in paragraph 2.2.2 (A) above. In case a particular job/ contract has been jointly executed by the Bidder (as part of a Consortium), it should further support its claim for the share in work done for that particular job/ contract by producing a certificate from its statutory auditor or the client; and (ii) Certificate(s) from its statutory auditors specifying the net worth of the Bidder, as at the close of the preceding financial year, and also specifying that the methodology adopted for calculating such net worth conforms to the provisions of this Clause 2.2.4 (ii). For the purposes of this RFP, net worth (the ?Net Worth?) shall mean the aggregate value of the paid-up share capital and all reserves created out of the profits and securities premium account, after deducting the aggregate value of the accumulated loses, deferred expenditure and miscellaneous expenditure not written off, as per the audited balance sheet, but does not include reserves created out of revaluation of assets, write back of depreciation and amalgamation. (iii) The bidder should furnish the availability (either owned or leased) of following minimum key and critical equipment required for the work. (a) Concrete Mixture with Hopper - 11 Nos. (b) Concrete Mixture with AJAX - 5 Nos. (c) JCB / Excavator - 10 Nos. (d) Hydraulic Cranes - 5 Nos. (e) Pin/Pan Vibrators - 40 Nos. (f) Water Tanker - 11 Nos. (g) Tractor / Tippers - 11 Nos. (iv) The bidder should furnish the availability of following key personnel. Sl. (vi) The Bidder shall submit the following documents as part of its Technical Bid: (a) Copy of Permanent Account Number (PAN) along with latest Income Tax Returns and proof of filing; (b) Valid Goods and Services Tax (GST) Registration Certificate; (c) Proof of payment of Professional Tax for the previous financial year, as applicable. The Bidder shall produce the original documents, when required, as part of the Bid evaluation process for verification by the Authority (d) Details of litigation history, including ongoing and completed cases, if any; (e) Geo-tagged photographs of the site visit along with a certificate duly attested by the Superintending Engineer / Executive Engineer of Mangalagiri Tadepalli Municipal Corporation. (f) Certificate from a Chartered Accountant certifying that the Bidder has not applied for or availed Corporate Debt Restructuring (CDR) or Strategic Debt Restructuring (SDR) during the last 5 (five) financial years. (g) The Bidder shall enter into a valid and enforceable Memorandum of Understanding (MoU) with manufacturers for supply of key materials, including DWC Pipes, RCC (NP3) Pipes, DI Pipes and House Service Connections (HSCs); (h) In the event that the Bidder is not itself a technology provider for Sewage Treatment Plants (?STPs?), the Bidder shall enter into a valid and enforceable Memorandum of Understanding (MoU) with a qualified and experienced STP technology provider having expertise in the design, construction, commissioning, operation and maintenance of STPs; provided that the Bidder may adopt any proven and established sewage treatment technology (?Open Technology?) which complies with the latest effluent discharge norms prescribed by the Central Pollution Control Board (CPCB) and the National Green Tribunal (NGT), and is suitable within the land footprint specified in the Bidding Documents; provided further that such technology shall have a demonstrable and proven track record of successful implementation in at least one Government-owned or Government-operated project in India, and the Bidder shall furnish third-party effluent test reports from a laboratory accredited by NABL evidencing compliance with the prescribed standards, along with a satisfactory performance certificate issued by the concerned authority not below the rank of Executive Engineer (or equivalent) and the latest in-house effluent test reports for the previous financial year, for an STP employing the same or similar technology having a minimum installed and operational capacity of 5 (five) MLD. Failure to submit the above documents shall render the Bid liable for rejection as non-responsive. 2.3 Proprietary data All documents and other information supplied by the Authority or submitted by a Bidder to the Authority shall remain or become the property of the Authority. Bidders are to treat all information as strictly confidential and shall not use it for any purpose other than for preparation and submission of their Bid. The Authority will not return any Bid or any information provided along therewith. 2.4 Cost of Bidding The Bidders shall be responsible for all of the costs associated with the preparation of their Bids and their participation in the Bidding Process. The Authority will not be responsible or in any way liable for such costs, regardless of the conduct or outcome of the Bidding Process. 2.5 Site visit and verification of information 2.5.1 Bidders are encouraged to submit their respective Bids after visiting the Project site and ascertaining for themselves the site conditions, location, surroundings, climate, availability of power, water & other utilities for construction, access to site, handling and storage of materials, weather data, applicable laws and regulations, and any other matter considered relevant by them. Bidders are advised to visit the site and familiarise themselves with the Project with in the stipulated time of submission of the Bid. No extension of time is likely to be considered for submission of Bids.

The bidder shall submit his response through Bid submission to the tender on eProcurement platform at www.apeprocurment.gov.in by following the procedure given below. The bidder would be required to register on the e-procurement market place https://tender.apeprocurement.gov.in and submit their bids online. Offline bids shall not be entertained by the Tender Inviting Authority for the tenders published in e-procurement platform. The bidders shall submit their eligibility and qualification details, Technical bid, Financial bid etc., in the online standard formats displayed in eProcurement web site. The bidders shall upload the scanned copies of all the relevant certificates, documents etc., in support of their eligibility criteria/technical bids and other certificate/documents in the eProcurement web site. The bidder shall sign on the statements, documents, certificates, uploaded by him, owning responsibility for their correctness/authenticity. The bidder shall attach all the required documents for the specific tender after uploading the same during the bid submission as per the tender notice and bid document. The Bidder shall also ensure prior to Final Bid submission that the Encryption certificate present in the DSC Key token is the same as that mapped into his Profile page in the Eprocurement system. G.O.Ms.No.174, I&CAD dept dated:1-9-2008, submission of original hard copies of the uploaded scanned copies of Proof of online Payment (Remittance)/BG towards EMD by participating bidders to the tender inviting authority before the opening of the price bid is dispensed forthwith. ii) All the bidders shall invariably upload the scanned copies of Proof of online Payment (Remittance)/BG in eProcurement system and this will be the primary requirement to consider the bid responsive. iii) The department shall carry out the technical evaluation solely based on the uploaded certificates/documents, Proof of online Payment (Remittance)/BG towards EMD in the eProcurement system and open the price bids of the responsive bidders. iv) The department will notify the successful bidder for submission of original hardcopies of all the uploaded documents Proof of online Payment (Remittance)/BG towards EMD prior to entering into agreement. v) The successful bidder shall invariably furnish the original Proof of online Payment (Remittance)/BG towards EMD, Certificates/Documents of the uploaded scan copies to the Tender Inviting Authority before entering into agreement, either personally or through courier or post and the receipt of the same within the stipulated date shall be the responsibility of the successful bidder. The department will not take any responsibility for any delay in receipt/non-receipt of original Proof of online Payment (Remittance)/BG towards EMD, Certificates/Documents from the successful bidder before the stipulated time. On receipt of documents, the department shall ensure the genuinity of the Proof of online Payment (Remittance)/BG towards EMD and all other certificates/documents uploaded by the bidder in eProcurement system. In support of the qualification criteria before concluding the agreement. 4. The GO. Ms. No. 174 -I&CAD dated: 1-9-2008 Deactivation of Bidders If any successful bidder fails to submit the original hard copies of uploaded certificates/documents, Proof of online Payment (Remittance)/BG towards EMD within stipulated time or if any variation is noticed between the uploaded documents and the hardcopies submitted by the bidder, as the successful bidder will be suspended from participating in the tenders on eProcurement platform for a period of 3 years. The eProcurement system would deactivate the user ID of such defaulting bidder based on the trigger/recommendation by the Tender Inviting Authority in the system. Besides this, the department shall invoke all processes of law including criminal prosecution of such defaulting bidder as an act of extreme deterrence to avoid delays in the tender process for execution of the development schemes taken up by the government. Other conditions as per tender document are applicable. The bidder is requested to get a confirmed acknowledgement from the Tender Inviting Authority a proof of Hardcopies submission to avoid any discrepancy. 5. Payment of EMD: It is mandatory for all participant bidders to electronically pay EMD Online by utilizing the 'Payment Gateway Service on E-Procurement platform'. The Electronic Payment Gateway accepts all Master and Visa Credit Cards issued by any bank and Direct Debit facility/Net Banking/NEFT payment modes through ICICI Bank and/or Axis Bank Payment Gateways to facilitate the transaction. This is in compliance as per G.O.Ms. 08 dated 08.05.2016. A GST of 18.00% + Bank charges on the transaction amount payable to APTS shall be applicable. In addition to this, Bidders can also pay the EMD through Download of PDF format of RTGS Challan for respective Payment gateway and pay the EMD through their Parent Bank account. Once the EMD is received by the EProcurement application, Bidders can automatically continue with their Bid Submission online. IMPORTANT NOTE REGARDING EMD PAYMENT: 1. Bidders are encouraged to use only Net banking facility for payment of EMDs as far as possible for faster refunds in case of unsuccessful Bids for the Tender. 2. Bidders are advised not to use RTGS Challan downloads at the penultimate hour of Bid submission closing as any delay by their banker would not enable Bid submission on the platform. Please allow a minimum of 60 minutes for enabling 'Continuation of Bid Submission' from the time the Pool Account receives credit of the EMD from the Bidders Bank for both NEFT and RTGS Transfers. For RTGS Transfers, the Pool Account can get immediate credit whereas NEFT transfers would follow RBI Payment Cycle time. 3. Bidders are advised to pay EMD Online atleast T-1 or T-2 days before Bid submission closing date (T= Bid submission closing date) to avoid last minute delays and denials of successful Bid submission and to take care of any delays in Banking procedures. Un Successful Bidder EMD Refund process: - The bid is declared unsuccessful, under the following circumstances. Bid submitted by the bidder is not the lowest bid. Upon Finalization of the L1 Bid. Technical Disqualification of the Bid in case of 2 cover system. EMD paid but bid not submitted EMD refund will be initiated by the Tender Inviting Authority directly and through Online only and through the same payment channels as EMD received by the Department. (RTGS / NEFT /Credit Card /Debit Card refund), within 30 days from the date of publishing the Decision / Result. However, Service Provider /GoAP will not be held responsible for the delays occurring due to banking channels/procedures/processes of the respective vendor. IMPORTANT NOTE REGARDING EMD REFUNDS: Bidders are requested to use discretion in their choice of payment channel for remittance of EMD. Time taken for Refunds under Ideal conditions: 1. Net Banking / NEFT / RTGS Challan: One (1) Banking Business Day from time of initiation of refund by Tender Inviting Authority subject to RTGS/NEFT timings of RBI. 2. Credit card/ Debit card: 7-10 working days from time of initiation of refund by the Tender Inviting Authority. However, this may be longer in case of certain bank cards. In case of delays, bidders are requested to contact the Card issuing Bank for faster resolution. 6. Payment of Transaction Fee: It is mandatory for all the participant bidders from 1st January 2006 to electronically pay a Non-refundable Transaction fee to M/s. APTS , the service provider through 'Payment Gateway Service on E-Procurement platform'. The Electronic Payment Gateway accepts all Master and Visa Credit Cards issued by any bank and Direct Debit facility/Net Banking of ICICI Bank, Axis Bank to facilitate the transaction. This is in compliance as per G.O.Ms. 13 dated 07.05.2006. A GST of 18.00% + Bank charges on the transaction amount payable to APTS shall be applicable. The participating bidders will pay a transaction fee @ 0.03% of ECV (estimated contract value) with a cap of Rs.10,000/- (Rupees ten thousand only) for all works with ECV upto Rs.50 crores, and Rs.25,000/- (Rupees twenty five thousand only) for works with ECV above Rs.50 crores, at the time of bid submission electronically. For tenders wherever ECV is not available i.e., for goods and services, the transaction fee shall be calculated on quoted value. GST as levied by the GOI on transaction fee, electronic payment gateway charges shall be borne by the bidders. 7. Corpus Fund: As per GO MS No.4 User departments shall collect 0.04% of ECV (estimated contract value) with a cap of Rs. 10,000 (Rupees ten thousand only) for all works with ECV upto Rs.50 Crores, and Rs. 25,000/- (Rupees twenty-five thousand only) for works with ECV above Rs.50 Crores, from successful bidders on eProcurement platform before entering into agreement / issue of purchase orders, towards eprocurement fund in favour of Managing Director, APTS . There shall not be any charge towards eProcurement fund in case of works, goods and services with ECV less than and upto Rs. 10 lakhs 8. Tender Document: The bidder is requested to download the tender document and read all the terms and conditions mentioned in the tender Document and seek clarification if any from the Tender Inviting Authority. Any offline bid submission clause in the tender document could be neglected. The bidder has to keep track of any changes by viewing the Addendum/Corrigenda issued by the Tender Inviting Authority on time-to- time basis in the E-Procurement platform. The Department calling for tenders shall not be responsible for any claims/problems arising out of this. 9. Bid Submission Acknowledgement: The bidder shall complete all the processes and steps required for Bid submission. The system will generate an acknowledgement with a unique bid submission number after completing all the prescribed steps and processes by the bidder. Users may also note that the bids for which an acknowledgement is not generated by the e-procurement system are treated as invalid or not saved in the system. Such invalid bids are not made available to the Tender Inviting Authority for processing the bids. The Government of AP are not responsible for incomplete bid submission by users.
