Based on the Committee recommendations the concerned District Forest Officers/Conservator of Forests should submit proposal to Conservator of Forests / Prl. Chief Conservator of Forests (HoFF) as per the powers to accord sanction of estimates for issuing confirmation orders. As per Circular No.01/2019: To check the quality and quantity of work done, instructions were issued in G.O Ms.No.2, EFS&T (For-III) Dept., dt.07.01.2004 under section 102 (3) (ix) that, “the Forest Department should setup a separate quality control wing and all the works should be subjected for verification by Quality Control wing and the final bill should be paid only after the Quality Control wing certifies the work”. Similarly instructions are also issued in CAMPA Manual of Guidelines under Quality Control item No.4.7.4. that, “in all the Divisions having Sub District Forest Officers, the Sub District Forest Officers shall act as quality control officers. For other divisions the respective Conservator of Forests will make necessary arrangements”. In view of the standing instructions issued in G.O Ms.No.2, EFS&T (For-III) dt.07.01.2004 and also the instructions issued in CAMPA Manual of Guidelines and even after provision for quality control in the estimate, it is observed that mechanism being followed by the executing agencies for proper quality and specifications for material before making payment to the contractor is not robust. It is also noted that there is shortage of field staff to ensure the same. Therefore, to ensure quality of Civil Works as per the standard specifications, it is necessary to engage qualified / authorized agencies for certification of the quality of work as third party evaluation before making final payments. Further, it is informed that provision for Overheads and Contractor profit charges to the extent of 13.615% on the estimated cost is also included in the data sheet for calculating the unit rate for the item of works such as Earth work excavation, PCC, RR & CRS Masonry, RCC, Brick Masonry & Plastering etc. As per CSSR 2018-19, this component shall be operative on all the data items of the estimates and the rates of the finished items published in the Building SOR for the original works subjected to fulfilment of the conditions given below: i. Site accommodation, setting up plant, access road, water supply, electricity and general site arrangements. ii. Office furniture, equipment and communications iii. Expenditure on: a) Corporate office of contractor b) Technical agents for site supervision (Reimbursement to the technical agents provision is dispensed with where over heads and contractor’s profit’ provision is included in the data rates) c) Documentation and as built” drawings d) Mobilization / de-mobilization of resources. e) Labour camps with minimum amenities and transportation to work sites. f) Light vehicles for site supervision including administrative and managerial requirements g) Laboratory equipment and quality control including field and laboratory testing. (For all the works costing more than Rs.2.00 crores contractors have to establish quality control laboratory) h) Minor T & P and Survey instruments and setting outworks, including verification of line, dimensions, etc. i) Watch and Ward j) Traffic management / Safety management during construction k) Expenditure on safeguarding environment iv. Sundries v. Financing Expenditure vi. Sales / Turn overtax (This is a material VAT component only, however the provision towards Works Contract Value Added Tax at 5% or as applicable on the finished work items as defined in APVAT Act – 2005 shall be added in the estimates) vii. Work Insurance / compensation – Works insurance is dispensed with vide G.O Ms.No.61, Irrigation & CAD (PW-REFORMS) Department, dt.25.06.2013. Out of the above items included under Over heads and Contractor profit, one of the item listed at iii (g) laboratory equipment and quality control including field and laboratory testing, the contractor has to fulfil the conditions. The contractor has to ensure that the materials used are tested for quality control with proper quality and specification of material as per Standard Specifications. But, it is observed that the executing authorities are not insisting to furnish the certification of the quality of material which is mandatory from the contractor before making payment. In view of the above, the following instructions are issued:- 1. Engage accredited / registered agencies only as 3rd party Quality Assurance agencies authorized by National Accreditation Board for Testing & Calibration Laboratories, (NABL) or agencies like ESCI, NAC, etc., that can perform the test for quality and specifications of the material in conformity with Detailed Standard Specifications. 2. To include as a clause in the Tender Bid document and as well as in the agreement that “the final payment will be made only after checking the quality and specifications of the material by the Departmental Officers as well as 3rd party agencies. 3. Provision for third party evaluation shall be made in all the forth coming and ongoing works. If not included in ongoing works, necessary supplement agreement shall be executed with the contractor and certification of the quality of work and specification of the material shall be issued by the third party agency before making the final payment to the contractor. 4. The charges for engaging the third party consultant should be borne by the contractor since, provision of 13.615% is provided in the estimate towards the overhead charges and contractor profit. The payment to the 3rd party agency shall be made in accordance with the progress of work done and submission of inspection report. 5. Finalisation of 3rd party for monitoring of quality shall be done by the Tender Committee at circle level duly calling the Tenders. 6. Agreement should be executed between the 3rd party agency and the executing authority. 7. Norms for engaging 3rd party Agency:- (i) NABL certified agencies / Government Laboratories only be engaged.
