The Agency shall provide uninterrupted service to the Department Condition
It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of e-Procurement on or before the last date and time of bid submission.
EMD Payments through e-Payment mode shall be made as one single transaction and payments made in part are liable for rejection.
Bidders shall not be under a declaration of ineligibility for corrupt and fraudulent practices issued by Government of Karnataka
The prices quoted shall be Firm basis only and no enhancement in prices is allowed during the contract period.
The prices shall be quoted in compliance of the relevant provisions under Labour Laws
Agency shall comply with all the provisions under Karnataka minimum wages Act, Labour Laws such as EPF, ESI, Minimum Wages, Payment of Wages etc., and provide the necessary proof of its compliance every month together with his bill. He shall comply with all the statutory requirements
The agency will be responsible for the discipline of the staff employed by them as per Conduct Rules and Regulations
Any dispute arising out of this agreement or that, which may arise in future, will be resolved by taking recourse to mutual settlement in the first instance, failing which the dispute will be subject to Mandya Jurisdiction only. CRO, Coastal Engineering Divison, KERS, K.R.Sagara is entitled to withhold payments due to the AGENCY in case of dispute till it is resolved.
The workers so employed on contract basis to the Karnataka Engineering Research Station will not be treated as employees of the Department.
The AGENCY shall strictly comply with the terms and conditions of agreement. In case of violation of any of the terms, the agreement shall be liable for cancellation with one-month prior notice.
Minimum premium for service charges is 3.85% otherwise bid shall be rejected.
